{"id":129216,"date":"2024-09-30T07:00:00","date_gmt":"2024-09-30T07:00:00","guid":{"rendered":"http:\/\/contapp.hype.ro\/concedii-medicale-pentru-activitati-independente\/"},"modified":"2025-11-27T11:59:48","modified_gmt":"2025-11-27T11:59:48","slug":"concedii-medicale-pentru-activitati-independente","status":"publish","type":"post","link":"https:\/\/contapp.ro\/blog\/concedii-medicale-pentru-activitati-independente\/","title":{"rendered":"Concediul medical la PFA \u0219i la Profesiile liberale"},"content":{"rendered":"\n<div class=\"wp-block-rank-math-toc-block\" id=\"rank-math-toc\"><h2>Cuprins articol<\/h2><nav><ul><li><a href=\"#concediul-medical-pentru-titularii-de-pfa-si-de-profesii-liberale\">Concediul medical pentru titularii de PFA si de Profesii Liberale<\/a><\/li><li><a href=\"#cum-obtinem-dreptul-de-a-primi-concediul-medical-ca-pfa\">Cum obtinem dreptul de a primi concediul medical ca PFA<\/a><\/li><li><a href=\"#contributia-de-plata-si-stagiul-minim-de-cotizare\">Contributia de plata si stagiul minim de cotizare<\/a><\/li><li><a href=\"#incasarea-indemniza\u021biei-de-concedii-medicale\">\u00cencasarea indemniza\u021biei de concedii medicale<\/a><\/li><\/ul><\/nav><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"concediul-medical-pentru-titularii-de-pfa-si-de-profesii-liberale\">Concediul medical pentru titularii de PFA si de Profesii Liberale<\/h3>\n\n\n\n<p>Persoanele fizice care NU ob\u021bin venituri din salarii \u0219i care desf\u0103\u0219oar\u0103 activit\u0103\u021bi independente, sunt \u00eendrept\u0103\u021bite s\u0103 primeasc\u0103 indemniza\u021bia de concediu medical pe perioada de incapacitate temporar\u0103 de munc\u0103 cauzat\u0103 de boal\u0103 sau accidente, <strong>dac\u0103 se asigur\u0103 pentru aceast\u0103 situa\u021bie.<\/strong><\/p>\n\n\n\n<p>Conform OUG 158\/2005 concediul pentru incapacitate temporar\u0103 de munc\u0103 este cauzat de o boal\u0103 obi\u0219nuit\u0103 sau accident din afara muncii \u0219i care \u00eempiedic\u0103 persoana fizic\u0103 s\u0103 \u00ee\u0219i desf\u0103\u0219oare activitatea o perioad\u0103 mai scurt\u0103 sau mai lung\u0103 de timp.<\/p>\n\n\n\n<p>Persoanele fizice care desf\u0103\u0219oar\u0103 activit\u0103\u021bi independente <strong>au op\u021biunea (nu \u0219i obliga\u021bia) de a se asigura pentru concedii \u0219i indemniza\u021bii de asigur\u0103ri sociale de s\u0103n\u0103tate.<\/strong><\/p>\n\n\n\n<p><strong>Trebuie s\u0103 facem distinc\u021bie \u00eentre:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Contribu\u021bia de asigur\u0103ri sociale de s\u0103n\u0103tate \u2013 CASS<\/strong> \u2013 care d\u0103 dreptul persoanei la servicii medicale \u00een sistemul public \u0219i<\/li>\n\n\n\n<li><strong>Contribu\u021bia pentru indemniza\u021bii medicale<\/strong> (concediul medical PFA) care ofer\u0103 dreptul persoanei fizice s\u0103 primeasc\u0103 o indemniza\u021bie \u00een cazul \u00een care sufer\u0103 un accident sau intr\u0103 \u00een incapacitate temporar\u0103 de munc\u0103 din cauza unei boli, conform certificatului medical emis de medicul autorizat;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"cum-obtinem-dreptul-de-a-primi-concediul-medical-ca-pfa\">Cum obtinem dreptul de a primi concediul medical ca PFA<\/h3>\n\n\n\n<p>Pentru a beneficia de indemniza\u021bie de concediu medical, persoana fizic\u0103 \u00eencheie contractul&nbsp;de asigurare cu Casa Na\u021bional\u0103 de Asigur\u0103ri de S\u0103n\u0103tate (CNAS). <a href=\"https:\/\/contapp.ro\/blog\/wp-content\/uploads\/2024\/09\/Model-contract-asigurare-concedii-medicale-pfa.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Un model de contract de concediu medical pentru PFA gasiti aici.<\/a><\/p>\n\n\n\n<p>\u00cen contract se stabile\u0219te perioada de asigurare, baza de calcul \u0219i contribu\u021bia lunar\u0103 datorat\u0103. De asemenea, casa de s\u0103n\u0103tate ofer\u0103 detalii cu privire la plata contribu\u021biei \u2013 contul bancar \u0219i date cu privire la modalitatea de ob\u021binere a indemniza\u021biei de concediu medical.<\/p>\n\n\n\n<p>Procentul de asigurare este de 1%, iar baza de calcul lunar\u0103 nu poate fi mai mic\u0103 dec\u00e2t valoarea salariului de baz\u0103 minim brut pe \u021bar\u0103, stabilit potrivit legii, \u0219i nici mai mare dec\u00e2t valoarea a de 3 a acestuia, dup\u0103 caz.<\/p>\n\n\n\n<p><strong>Important!<\/strong> \u00cencep\u00e2nd cu 15 martie 2023 baza de calcul a indemniza\u021biilor \u0219i a contribu\u021biilor de plat\u0103 este &#8222;&#8230;<strong>este venitul lunar sau, dup\u0103 caz, media lunar\u0103 a venitului \u00eenscris \u00een declara\u0163ia fiscal\u0103 depus\u0103 \u00een vederea <\/strong>pl\u0103\u0163ii contribu\u0163iei de asigur\u0103ri sociale de s\u0103n\u0103tate, (declara\u021bia unic\u0103), care nu poate fi mai mic dec\u00e2t valoarea unui salariu de baz\u0103 minim brut pe \u0163ar\u0103 garantat \u00een plat\u0103, stabilit potrivit legii, \u015fi nu poate dep\u0103\u015fi valoarea a de 3 ori a acestuia.<\/p>\n\n\n\n<p>\u201c(2)Salariul de baz\u0103 minim brut pe \u0163ar\u0103 utilizat la stabilirea bazei lunare de calcul al contribu\u0163iei este salariul de baz\u0103 minim brut pe \u0163ar\u0103 garantat \u00een plat\u0103 stabilit prin hot\u0103r\u00e2re a Guvernului, <strong>aferent lunii pentru care se opteaz\u0103 plata contribu\u0163iei<\/strong>.\u201d<\/p>\n\n\n\n<figure id=\"contributia-de-plata-si-stagiul-minim-de-cotizare\">Contributia de plata si stagiul minim de cotizare<\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background has-fixed-layout\" style=\"background-color:#e6edf7\"><tbody><tr><td><strong>La\u00a0 data de 1 ianuarie 2025, baza de calcul pentru concedii medicale:<\/strong><br>&#8211; Baza de calcul lunar\u0103 minim\u0103 = 4.050 x 1% =41 de lei, contribu\u021bie datorat\u0103;<br>&#8211; Baza de calcul lunar\u0103 maxim\u0103 = 12.150 x 1% = 122 de lei, contribu\u021bie datorat\u0103.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Stagiul minim de asigurare pentru acordarea indemniza\u021biei este de 6 luni realizate \u00een ultimele 12 luni anterioare lunii pentru care se acord\u0103 concediul medical.<\/p>\n\n\n\n<p>Contribu\u021bia datorat\u0103 se calculeaz\u0103 lunar \u0219i se pl\u0103te\u0219te \u00een contul CNAS deschis la trezorerie, p\u00e2n\u0103 la data de 25 a lunii urm\u0103toare, (\u00een contract se va specifica contul IBAN). Plata contribu\u021biei se poate efectua \u0219i anticipat\u0103 pe o perioad\u0103 de maxim 12 luni. Neplata la termen a contribu\u021biei conduce la calcularea de dob\u00e2nzi \u0219i penalit\u0103\u021bi.<\/p>\n\n\n\n<p>Contractul de asigurare \u00eenceteaz\u0103 la cererea persoanei asigurate sau dac\u0103 contribu\u021bia nu este pl\u0103tit\u0103 timp de 2 luni, consecutiv.<\/p>\n\n\n\n<p>Persoanele care au calitatea de salariat, de pensionar sau de \u0219omer nu se pot asigura conform prevederilor de mai sus.<\/p>\n\n\n\n<div class=\"wp-block-group has-border-color has-black-border-color has-background is-layout-constrained wp-container-core-group-is-layout-3a02abfb wp-block-group-is-layout-constrained\" style=\"border-width:1px;background-color:#f4eeee;padding-top:20px;padding-right:20px;padding-bottom:20px;padding-left:20px\">\n<p><strong>Important! <\/strong>Contribu\u021bia pl\u0103tit\u0103 nu este deductibil\u0103 la calculul venitului net a activit\u0103\u021bii desf\u0103\u0219urate, dac\u0103 persoana fizic\u0103 desf\u0103\u0219oar\u0103 activitate economic\u0103 (ca PFI, PFA, II, IF, Profesie Liberal\u0103). Contribu\u021bia nu este deductibil\u0103 pentru c\u0103 nu este realizat\u0103 \u00een scopul activit\u0103\u021bii, nu este obligatorie \u0219i este f\u0103cut\u0103 \u00een scopul personal al titularului activit\u0103\u021bii economice. De asemenea, indemniza\u021bia de concediu medical nu este impozabil\u0103 \u0219i nu se \u00eenregistreaz\u0103 \u00een Registrul Jurnal de \u00cencas\u0103ri \u0219i Pl\u0103\u021bi.<\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"incasarea-indemniza\u021biei-de-concedii-medicale\">\u00cencasarea indemniza\u021biei de concedii medicale<\/h3>\n\n\n\n<p>Pentru ob\u021binerea indemniza\u021biei, persoana fizic\u0103 asigurat\u0103 trebuie s\u0103 prezinte la Casa de S\u0103n\u0103tate, urm\u0103toarele documente:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Concediul medical emis de medicul autorizat de CNAS;<\/li>\n\n\n\n<li>Copie CI;<\/li>\n\n\n\n<li>Extras de cont bancar deschis pe numele persoanei fizice;<\/li>\n\n\n\n<li>Copie contract de asigurare;<\/li>\n<\/ul>\n\n\n\n<p>Indemniza\u021bia brut\u0103 calculat\u0103 NU este impozabil\u0103 dar se re\u021bine contribu\u021bia de asigur\u0103ri sociale \u2013 CAS, \u00een procent de 25%.<\/p>\n\n\n\n<p>CNAS calculeaz\u0103 indemnizatia de concedii medicale, re\u021bine obliga\u021biile conform legii \u0219i vireaz\u0103 indemnizatia net\u0103 \u00een contul persoanei fizice.<\/p>\n\n\n\n<p>Indemniza\u021bia brut\u0103 se calculeaz\u0103 \u00een func\u021bie de diagnostic \u0219i de baza de calcul a contribu\u021biei stabilit\u0103 \u00een contract raportat\u0103 la num\u0103rul de zile lucr\u0103toare. Conform Ordonan\u021bei de urgen\u021b\u0103 158\/200 sunt mai multe categorii de diagnostic, fiec\u0103rei categorii \u00eei corespunde un procent care se aplic\u0103 la baza de calcul \u0219i se ob\u021bine \u00eendemniza\u021bia brut\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>01 \u2013 Boal\u0103 obi\u0219nuit\u0103 \u2013 75%<\/li>\n\n\n\n<li>02 \u2013 Accident \u00een timpul deplas\u0103rii la\/de la locul de munc\u0103 \u2013 100%\/80%<\/li>\n\n\n\n<li>03 \u2013 Accident de munc\u0103 \u2013 100%\/80%<\/li>\n\n\n\n<li>04 \u2013 Boal\u0103 profesional\u0103 \u2013 100%\/80%<\/li>\n\n\n\n<li>05 \u2013 Boal\u0103 infectocontagioas\u0103 din grupa A \u2013 100%<\/li>\n\n\n\n<li>06 \u2013 Urgen\u021b\u0103 medico-chirurgical\u0103 \u2013 100%<\/li>\n\n\n\n<li>07 \u2013 Carantin\u0103 \u2013 75%<\/li>\n\n\n\n<li>08 \u2013 Sarcin\u0103 \u0219i lauzie \u2013 85%<\/li>\n\n\n\n<li>09 \u2013 \u00cengrijire copil bolnav \u00een v\u00e2rst\u0103 de p\u00e2n\u0103 la \u0219apte ani sau copil cu handicap pentru afec\u021biuni, p\u00e2n\u0103 la \u00eemplinirea v\u00e2rstei de 18 ani \u2013 85%<\/li>\n\n\n\n<li>10 \u2013 Reducerea cu 1\/4 a duratei normale de lucru \u2013 F\u0103r\u0103 a dep\u0103\u0219i 25% din baza de calcul<\/li>\n\n\n\n<li>11 \u2013 Trecerea temporar\u0103 \u00een alt\u0103 munc\u0103 \u2013 F\u0103r\u0103 a dep\u0103\u0219i 25% din baza de calcul<\/li>\n\n\n\n<li>12 \u2013 Tuberculoz\u0103 \u2013 100%<\/li>\n\n\n\n<li>13 \u2013 Boal\u0103 cardiovascular\u0103 \u2013 75%<\/li>\n\n\n\n<li>14 \u2013 Neoplazii, SIDA \u2013 100%<\/li>\n\n\n\n<li>15 \u2013 Risc maternal \u2013 75%<\/li>\n<\/ul>\n\n\n\n<p>Indemniza\u021bia se calculeaz\u0103 prin aplicarea procentului asupra bazei de calcul determinat\u0103 ca media veniturilor brute lunare realizate \u00een ultimele 6 luni din ultimele 12 anterioare solicit\u0103rii concediului \u0219i \u00een raport cu num\u0103rul de zile lucr\u0103toare din perioada de indisponibilitate a persoanei asigurate.<\/p>\n\n\n\n<div class=\"wp-block-group has-background is-layout-constrained wp-block-group-is-layout-constrained\" style=\"background-color:#fffadc\">\n<p><strong>Exemplu: <\/strong>O persoan\u0103 fizic\u0103, cu domiciliul \u0219i re\u0219edin\u021ba \u00een Rom\u00e2nia, care desf\u0103\u0219oar\u0103 o activitate independent\u0103 impus\u0103 cu norm\u0103 de venit, \u00eencheie un contract cu Casa Na\u021bional\u0103 de Asigur\u0103ri de S\u0103n\u0103tate pentru concedii \u0219i indemniza\u021bii de asigur\u0103ri sociale de s\u0103n\u0103tate, \u00een data de 1 martie 2024.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pentru anul 2024 persoana fizica estimeaz\u0103 un venit mediu lunar de 6.000 lei<\/li>\n\n\n\n<li>Conform contractului \u00eencheiat, persoana se asigur\u0103 pe o perioad\u0103 nedeterminat\u0103, la baza de calcul lunar\u0103 de 6.000 lei.<\/li>\n\n\n\n<li>Contribu\u021bia lunar\u0103 de plat\u0103 este egal\u0103 cu: 6.000&nbsp; x&nbsp; 1% = 60 lei<\/li>\n\n\n\n<li>Persoana pl\u0103te\u0219te anticipat contribu\u021bia p\u00e2n\u0103 la sf\u00e2r\u0219itul anului 2024.&nbsp;60 * 10 luni = 600 lei<\/li>\n\n\n\n<li>La data de 1 noiembrie 2024 persoana intr\u0103 \u00een concediu de sarcin\u0103 \u0219i l\u0103uzie.<\/li>\n\n\n\n<li>\u00cen baza certificatului medical emis de medicul specialist persoana depune actele la Casa Na\u021bional\u0103 de asigur\u0103ri de s\u0103n\u0103tate pentru acordarea indemniza\u021biei de sarcin\u0103 \u0219i l\u0103uzie.<\/li>\n\n\n\n<li>Conform reglement\u0103rilor legale concediul de sarcin\u0103 \u0219i l\u0103uzie poate fi acordat pe o perioad\u0103 de maxim 126 de zile.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Concediul medical pentru titularii de PFA si de Profesii Liberale Persoanele fizice care NU ob\u021bin venituri din salarii \u0219i care desf\u0103\u0219oar\u0103 activit\u0103\u021bi independente, sunt \u00eendrept\u0103\u021bite s\u0103 primeasc\u0103 indemniza\u021bia de concediu medical pe perioada de incapacitate temporar\u0103 de munc\u0103 cauzat\u0103 de boal\u0103 sau accidente, dac\u0103 se asigur\u0103 pentru aceast\u0103 situa\u021bie.
